These Terms and Conditions (“Terms”) apply to purchases made through the online store BYMA, available at bymashop.com.

Hereinafter referred to as “BYMA”, “we”, “us” or the “Seller”.


1. Scope

These Terms apply to all contracts concluded between BYMA and customers through bymashop.com.

A consumer is a natural person purchasing goods primarily for purposes that are not attributable to their commercial or independent professional activity.

Mandatory consumer protection laws applicable in the customer’s country of habitual residence remain unaffected where such laws apply.

Any terms submitted by the customer that deviate from these Terms shall not apply unless expressly accepted by BYMA.


2. Product Information

The presentation of products in our online store does not constitute a legally binding offer but an invitation for customers to submit an order.

We make reasonable efforts to ensure that product descriptions, specifications, photographs, dimensions and other information are accurate.

Minor differences may occur due to:

  • screen and display settings;
  • manufacturing batches;
  • packaging updates;
  • lighting used in product photography;
  • minor design or colour variations.

Such differences do not affect a customer’s statutory rights where a product materially differs from what was agreed.

Decorative objects or accessories shown in product photographs are not included unless expressly stated in the product description.


3. Order Process and Conclusion of Contract

Customers may select products and add them to their shopping cart.

Before submitting an order, customers have the opportunity to review and correct the information entered during checkout.

By clicking the final purchase button, the customer submits a binding offer to purchase the selected products.

After an order has been placed, BYMA will send an electronic confirmation of receipt.

Unless expressly stated otherwise, an automated confirmation that an order has been received does not by itself constitute acceptance of the customer’s offer.

The purchase contract is concluded when:

  • BYMA expressly accepts the order;
  • a shipping confirmation is issued; or
  • the ordered goods are dispatched,

whichever occurs first.

BYMA reserves the right to reject or cancel an order where legally permissible, particularly where:

  • an item is unavailable;
  • an obvious pricing or technical error has occurred;
  • payment cannot be authorised;
  • the shipping address cannot be serviced;
  • fraud or misuse is reasonably suspected.

If payment has already been received for an order that cannot be fulfilled, the relevant amount will be refunded.


4. Prices

Prices shown in the online store are the prices applicable at the time the order is placed.

Applicable taxes will be displayed or included as required by law and according to the customer’s destination.

Shipping costs, where applicable, are displayed before the customer submits the order.

Customers will not be charged undisclosed mandatory costs after submitting an order.


5. Customs, Import Taxes and Duties

Products may be fulfilled and shipped from locations outside the customer’s country.

International shipments may therefore be subject to customs procedures, import duties, local taxes or other governmental charges.

Whether such charges are already included depends on the destination country and shipping method.

Where duties, taxes or import charges are not collected by BYMA at checkout or prepaid as part of the shipment, they may be charged directly to the recipient by customs authorities or the carrier.

BYMA will not intentionally represent import charges as included where they are not.

Customers are responsible for complying with applicable import restrictions in their country.


6. Payment

Customers may pay using the payment methods displayed during checkout.

Depending on availability, payment methods may include credit or debit cards, Shopify Payments, PayPal or other payment providers.

BYMA reserves the right to add, remove or restrict payment methods.

Payments may be processed by third-party payment providers. Their own terms and privacy practices may also apply.

Customers are responsible for providing accurate payment and billing information.


7. Order Processing

Orders are processed before shipment.

Processing times may vary depending on:

  • the product;
  • fulfilment location;
  • stock availability;
  • destination country;
  • public holidays;
  • unusually high order volumes.

Any specific processing time displayed on the relevant product page forms part of the information provided before purchase.


8. Delivery Times

Unless otherwise stated on the relevant product page, estimated delivery times are generally:

Most destinations: approximately 10–14 business days

United States: up to approximately 20 business days

These delivery periods are estimates and are not guaranteed delivery dates unless a binding delivery date has expressly been agreed.

Delivery may occasionally take longer due to circumstances such as customs processing, carrier disruption, severe weather or other events outside BYMA’s reasonable control.

BYMA will not intentionally advertise delivery times that it knows cannot realistically be met.


9. Fulfilment and Dropshipping

BYMA works with external suppliers, fulfilment partners and shipping providers, including international fulfilment services.

As a result, goods may be dispatched directly from a fulfilment partner or warehouse to the customer.

The fact that a third-party fulfilment provider ships the goods does not change the customer’s contractual relationship with BYMA.

BYMA remains the seller and contractual contact for the customer.

Customers should therefore contact BYMA rather than the fulfilment provider if they have questions concerning an order, return, defective product or refund.


10. Multiple Shipments

Where an order contains multiple products, the products may be dispatched from different fulfilment locations.

An order may therefore arrive in more than one package and on different days.

Customers will not incur additional shipping charges solely because BYMA divides an order into multiple shipments unless additional charges were clearly disclosed before purchase.


11. Tracking

Where tracking is available, customers will receive tracking information after the relevant shipment has been dispatched.

Tracking data may require several days to become active following dispatch.

Customers may also use the Track Your Order section on bymashop.com where available.


12. Delivery Address

Customers are responsible for entering their shipping address correctly during checkout.

If an incorrect address has been submitted, the customer should contact:

support@bymashop.com

as soon as possible.

We will make reasonable efforts to correct the address before dispatch.

Once an order has entered fulfilment or has been shipped, changes may no longer be possible.

This clause does not restrict mandatory consumer rights.


13. Failed Delivery and Unclaimed Parcels

If delivery is unsuccessful because the address supplied by the customer is incorrect, incomplete or inaccessible, or because a parcel is not collected, the shipment may be returned to the fulfilment provider or another return facility.

Customers should contact BYMA if a shipment has been returned.

Any costs associated with a new shipment will be assessed according to the circumstances of the case and applicable law.


14. Right of Withdrawal and Voluntary Returns

Customers in Switzerland

Swiss law does not generally provide consumers with an automatic statutory right to withdraw from an ordinary online purchase simply because they have changed their mind.

However, BYMA voluntarily offers eligible customers a 14-day return period, subject to the conditions stated in our Return & Refund Policy.

This voluntary return policy does not limit any mandatory legal rights.

Customers in the European Union / EEA

Where BYMA directs its commercial activities to a customer’s EU or EEA country and mandatory consumer law applies, eligible consumers retain any statutory rights that cannot lawfully be excluded.

This may include a statutory 14-day right of withdrawal for distance purchases, subject to applicable exceptions.

Where mandatory EU consumer law provides greater protection than these Terms, the mandatory consumer protection rules shall prevail.

Other Countries

Customers outside Switzerland and the EU/EEA may be entitled to rights under the laws applicable in their jurisdiction.

In addition, BYMA may offer voluntary returns in accordance with the Return & Refund Policy.


15. Return Procedure

Customers wishing to return a product must first contact:

support@bymashop.com

and provide:

  • their order number;
  • the product concerned;
  • the reason for the return where relevant;
  • photographs where the item is damaged, defective or incorrect and providing photographs is reasonably possible.

BYMA will then provide the applicable return instructions.

Important

Customers must not automatically return goods to the address printed on the original parcel.

The shipping origin may belong to a carrier, warehouse or fulfilment partner and may not be authorised to process customer returns.

The correct return destination may vary depending on the product, fulfilment location and reason for return.

Goods returned to an unauthorised address may not be capable of being identified or processed.


16. Return Shipping Costs

For voluntary change-of-mind returns, the customer may be responsible for the direct cost of returning the goods, where permitted by applicable law and provided the customer has been appropriately informed.

Where EU statutory withdrawal rules apply, the customer bears the direct return cost if this has been properly disclosed before purchase, unless BYMA agrees to bear that cost.

Where goods are defective, damaged, incorrectly supplied or otherwise non-conforming, return costs will be handled in accordance with mandatory applicable law.


17. Condition of Returned Goods

Returned goods should, where reasonably possible, include:

  • all supplied components;
  • accessories;
  • manuals;
  • packaging;
  • promotional items supplied specifically with the product.

Consumers exercising a mandatory statutory withdrawal right are only responsible for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, where applicable law so provides.

Failure to retain original packaging does not automatically remove mandatory statutory rights.


18. Products Excluded From Change-of-Mind Returns

A statutory or voluntary right of return may be excluded where permitted by law, including for certain:

  • personalised or custom-made products;
  • goods made to customer specifications;
  • sealed hygiene or health-protection products where the seal has been removed;
  • goods that deteriorate or expire rapidly;
  • other products legally exempt from withdrawal or return rights.

A product will not be treated as non-returnable merely because it belongs to the beauty, wellness or personal-care category. The relevant legal conditions must actually be met.


19. Refunds

Where a refund is due, it will normally be made using the payment method used for the original transaction unless otherwise agreed.

Processing times may vary depending on the payment provider.

Where statutory EU withdrawal rules apply, the applicable statutory refund deadlines remain unaffected.

BYMA may withhold a statutory withdrawal refund until the returned goods have been received or the customer provides evidence that they have been returned, where applicable law permits this.


20. Damaged, Defective or Incorrect Products

Customers should inspect goods as soon as reasonably possible after delivery.

If a product arrives:

  • damaged;
  • defective;
  • incomplete;
  • materially different from the product ordered; or
  • if the wrong product has been delivered,

the customer should contact:

support@bymashop.com

and provide the order number and a description of the problem.

Photographs or video may be requested where reasonably necessary to assess the issue.

The inability to provide photographs does not automatically remove statutory consumer rights.

BYMA will provide the remedy required under applicable law, which may include repair, replacement, price reduction, cancellation or refund depending on the circumstances and applicable legal rules.


21. Warranty and Defective Goods

Mandatory statutory warranty rights remain unaffected.

Under Swiss law, statutory claims relating to defects in goods may generally be asserted within the applicable statutory warranty period.

Where mandatory consumer law of another country applies, any stronger mandatory warranty rights remain unaffected.

For customers protected by applicable EU consumer legislation, goods must comply with the contract and consumers may have a minimum two-year legal guarantee for defective or non-conforming goods.

Any commercial guarantee offered by BYMA or a manufacturer is additional to statutory rights and does not replace them.


22. Product Safety

BYMA aims to offer products that comply with the legal product safety requirements applicable to the markets in which they are sold.

Customers must follow product instructions, safety warnings, age restrictions and intended-use information supplied with the relevant product.

Products must not be used for purposes for which they were not designed.

Nothing in these Terms limits BYMA’s responsibility where liability cannot lawfully be excluded.


23. Health and Wellness Products

Products sold within categories such as Health & Wellness, Beauty & Care or Fitness & Active are not intended to replace professional medical advice, diagnosis or treatment unless a product is expressly and lawfully marketed as a regulated medical product.

General wellness or lifestyle product information does not constitute medical advice.

Customers should follow all instructions and warnings supplied with the product.


24. Ownership of Goods

To the extent permitted by applicable law, goods remain the property of BYMA until payment has been received in full.


25. Liability

BYMA does not exclude or restrict liability where such exclusion or restriction would be unlawful.

In particular, nothing in these Terms excludes liability for:

  • intentional misconduct;
  • gross negligence where exclusion is prohibited;
  • death or personal injury where liability cannot lawfully be excluded;
  • product liability that cannot legally be excluded;
  • breach of mandatory consumer protection law.

For other losses, liability may be limited to the extent permitted by applicable law.


26. Force Majeure

BYMA shall not be responsible for failure or delay caused by circumstances outside its reasonable control where and to the extent permitted by law.

Such circumstances may include:

  • severe weather;
  • natural disasters;
  • war or civil disturbance;
  • governmental restrictions;
  • customs disruption;
  • major transportation interruption;
  • strikes;
  • epidemics or pandemics;
  • widespread infrastructure failure.

Mandatory consumer rights remain unaffected.


27. Intellectual Property

Unless otherwise stated, content on bymashop.com, including:

  • BYMA branding;
  • logos;
  • graphics;
  • website design;
  • text;
  • photographs;
  • promotional material,

is owned by BYMA or used with appropriate permission.

Content may not be reproduced, commercially exploited or distributed without prior permission except where permitted by law.


28. Customer Accounts

Customers may have the option to create a BYMA customer account.

Customers are responsible for keeping login credentials confidential.

Customers should notify BYMA if they believe their account has been accessed without authorisation.

BYMA may restrict or suspend an account where there is reasonable evidence of fraud, misuse or a serious breach of these Terms.


29. Promotions and Discount Codes

Promotional codes are subject to the conditions communicated with the relevant promotion.

Unless expressly stated otherwise:

  • discount codes cannot be exchanged for cash;
  • only one promotional code may be used per order;
  • promotional codes may expire;
  • promotions may exclude certain products;
  • promotions may not be applied retrospectively.

Mandatory consumer rights remain unaffected.


30. Reviews and User Content

Where customers can submit reviews, photographs or other content, they must not submit content that is:

  • unlawful;
  • defamatory;
  • fraudulent;
  • discriminatory;
  • infringing of third-party rights;
  • misleading;
  • malicious.

BYMA may remove content where necessary to comply with law or platform rules.

Reviews will not knowingly be presented as genuine customer reviews if they have not been submitted by genuine customers or otherwise clearly identified.


31. Fraud and Misuse

BYMA reserves the right to investigate orders where there are reasonable indications of fraud, payment misuse, chargeback abuse or other unlawful activity.

An order may be delayed or cancelled where reasonably necessary for fraud prevention and legally permissible.


32. Data Protection

Personal information is processed in accordance with BYMA’s separate Privacy Policy.

The Privacy Policy explains, among other matters:

  • the categories of personal information processed;
  • purposes of processing;
  • service providers;
  • payment processing;
  • fulfilment;
  • shipping;
  • cookies;
  • analytics;
  • marketing;
  • customer rights.


33. Electronic Communications

By placing an order, customers acknowledge that transaction-related communications may be sent electronically, including:

  • order confirmations;
  • payment confirmations;
  • shipping updates;
  • delivery information;
  • return information;
  • customer service communications.

Marketing communications are subject to separate consent requirements where applicable.


34. Applicable Law

These Terms and contracts concluded with BYMA are governed by Swiss law, subject to mandatory consumer protection provisions.

The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded where legally permissible.

Where a consumer resides in a country whose mandatory consumer laws apply to the transaction, this choice of Swiss law does not deprive that consumer of protections that cannot lawfully be excluded by contract.


35. Jurisdiction

Any jurisdiction provision shall apply only to the extent permitted by mandatory law.

For consumers, mandatory statutory rules concerning jurisdiction remain unaffected.

BYMA does not require consumers to bring proceedings exclusively in Switzerland where applicable mandatory law grants the consumer the right to bring proceedings elsewhere.


36. Amendments to These Terms

BYMA may update these Terms from time to time.

The Terms applicable to an order are generally those made available to the customer at the time the order was placed, subject to mandatory law.

Changes will not retrospectively remove rights already acquired under an existing contract.


37. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain effective to the extent permitted by law.

The invalid provision shall not be replaced by a provision that unfairly disadvantages consumers.
